How to Appeal a CCW Denial in California

Being denied a concealed carry weapon (CCW) permit in California can be extremely frustrating. Getting a CCW license is not guaranteed, even if it seems like you did everything right. Law enforcement has significant discretion in deciding who qualifies to carry a firearm in public.

That said, you should know that if your application was denied, you may not be out of options. You could have the right to appeal the decision and present evidence to show that you should be granted the permit.

California’s CCW Requirements

Under state law, beginning with California Penal Code §§ 26150, local sheriffs and police chiefs have the authority to issue concealed carry permits

To qualify, applicants must generally show that they:

  • Are of good moral character and sound mind
  • Are a resident of the area where they apply
  • Have completed an approved firearm safety and training course

The “good cause” standard once gave local agencies wide discretion. However, the U.S. Supreme Court’s 2022 decision in N.Y. State Rifle & Pistol Association v. Bruen significantly changed how California applies this requirement. The ruling limited the ability of states to deny CCW permits based on subjective criteria. As a result, states like California were forced to review their policies.

Common Reasons for CCW Denials

A CCW application in California may be denied for several reasons, including:

  • A criminal record 
  • Pending charges
  • History of mental health issues 
  • Incomplete information on the application

Sometimes, applications are denied simply because the reviewing agency misinterpreted information. In these cases, appealing the decision may be a wise move.

How Do I Appeal a CCW Denial?

If your permit is denied, you likely have the right to request an appeal. The exact procedure depends on exactly where you applied, but most follow a similar process at least to some extent.

Request Written Notice of Denial 

The agency must provide written notice explaining why your CCW application was denied. This document is critical because it outlines the reasons you’ll need to address during your appeal.

File an Administrative Appeal 

You typically have 30 days to submit an appeal in writing. Your appeal should include documentation showing you meet all eligibility requirements and addressing any alleged deficiencies.

Provide Supporting Evidence 

Depending on the reason for denial, you may need to submit additional proof, such as:

  • Character references 
  • Letters of recommendation
  • Proof of firearm training 
  • Proof of safety certification
  • Documentation showing that prior issues have been resolved

Attend a Hearing
